Software as a Service (SaaS) Terms of Service
1. Definitions
“Service”: Waikay and/or AI Scanner, including all associated software, platforms, and documentation.
“User”: Any individual or entity accessing or using the Service.
“Subscription”: The User’s right to access and use the Service, granted for a specified period.
“Data”: Any data, information, or content submitted, uploaded, or processed by the User through the Service.
2. Service Description
The Service provides Brand visibility metrics in LLMs. We will use reasonable endeavours to maintain Service availability, but no guarantee of uninterrupted access is provided. Scheduled and unscheduled downtime for maintenance may occur.
3. User Responsibilities
Users are responsible for maintaining the confidentiality of their account credentials. Users must not use the Service for any unlawful purpose, including but not limited to: distributing malware, spamming, or engaging in unauthorised access.
4. Subscription, Payment & Refund Policy
This is a B2B technology and not primarily designed for consumers. Any business that takes an onboarding demo of the product may cancel within 14 days of starting a subscription for a full refund. A consumer may also use the product and may cancel and receive a refund when requested within the first 14 days of a subscription. Subscription fees are as detailed on the pricing at waikay.io. Payments are due in advance and after the 14 day cooling off period, are non-refundable. Subscriptions will automatically renew unless cancelled by the User at least 1 working day prior to the renewal date.
5. Data Privacy and Security
We will process User Data in accordance with the Privacy Policy at ai-scanner.net/privacy, which forms part of these Terms. We employ reasonable security measures to protect User Data, but cannot guarantee absolute security.
6. Intellectual Property Rights
All intellectual property rights in the Service, including but not limited to copyrights, trademarks, and trade secrets, belong exclusively to InLinks Optimization LTD. Users are granted a non-exclusive, non-transferable licence to use the Service for the duration of their Subscription.
7. Warranties and Disclaimers
The Service is provided “as is” and “as available” without any warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all liability for any loss or damage arising from the use of the Service, including indirect, incidental, or consequential damages. Our total liability to the User in any 12-month period shall be limited to the total fees paid by the User for the Service during that period.
8. Term and Termination
This agreement shall continue until the User’s Subscription is terminated. We reserve the right to terminate this agreement with immediate effect if the User breaches these Terms. Upon termination, User access to the Service will cease. User Data may be deleted after 30 days of termination.
9. Credits and Free Accounts
Where a user has unused credits without a paid subscription, any credits and/or account may be removed after three months of inactivity without further notification or warning.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the English courts.
11. General Provisions
These Terms constitute the entire agreement between us and the User relating to the Service. We reserve the right to modify these Terms at any time. Users will be notified of any changes. Continued use of the Service after notification constitutes acceptance of the revised Terms.
